Get angry at Apple over Galaxy Nexus ban, but get angrier at Google

In case you haven't been keeping up with World War Patents, Apple has successfully gotten the U.S. courts to impose an import ban on Samsung's Galaxy Nexus, and you can no longer buy it online, and stores likely can no longer stock it once U.S. supplies dry up. Google is apparently working on a software update to remove the parts of their search interface that infringe on Apple's Siri patents, but a better remedy might just have been to leave it on the shelves, allow the update, and up the damages owed Apple. That way Google pays, not consumers. Now many Android enthusiasts are absolutely livid at Apple over this ban They claim Apple is litigating instead of innovating. Unfortunately, Apple is doing both. Either way, that conveniently sidesteps something incredibly important. A lot of Android's problems are Google's fault.

Fourth Of July: 5 Ways The Holiday Affects Your Sleep

This year, the Fourth of July falls on a Wednesday, and that mid-week day off is undoubtedly messing with your travel plans -- but it could also be affecting a key part of a healthy life: your sleep.

Nearly a third of American workers say they get fewer than six hours of sleep a night, and while we don?t expect that to stop anyone from celebrating Independence Day, there are a few ways to combat the effects of skimping on sleep to salute the grand old flag.

  • The Fireworks

    The big show can't start until it's dark out, but for some, that could mean delaying bedtime on the night of the Fourth. "There's a tendency to stay up late on your day off," Kelly Glazer Baron, Ph.D., M.P.H, a sleep researcher and neurology instructor at Northwestern University's Feinberg School of Medicine. "The problem is you have to get up early for work the next day, so you're going to have insufficient sleep that night." "If you do stay up," she says, "[still] try to get an adequate amount of sleep to keep your body's sleep balance in line." If you can only swing six or seven hours, get outside for some bright light first thing in the morning, she says, which can help put your <a href="http://www.huffingtonpost.com/2012/03/10/daylight-saving-time-2012-time-change_n_1332869.html" target="_hplink">circadian rhythms back on a normal schedule</a>.   • The Cookout

    While those hot dogs and hamburgers are tempting, be careful not to over-indulge too close to bedtime. "We don't recommend eating late at night -- don't go to bed hungry, but you shouldn't have a large meal," says Baron. "The biggest concern I'd have is heartburn and indigestion." Lying down too quickly after scarfing down a big meal can encourage stomach acid to reflux into the esophagus.   • The Alcohol

    Americans buy more than <a href="http://blog.nielsen.com/nielsenwire/consumer/9-in10-will-watch-super-bowl-at-home-most-will-spend-the-same-or-less-on-food-and-bev/" target="_hplink">63 million cases of beer</a> in the two weeks surrounding July 4, according to The Neilsen Company. (For comparison's sake, the two weeks around the Super Bowl only see 49 million cases sold). You might think that a cold beer would help you nod off after the hot day, and it might, initially, says Baron. But "in the second half of the night, as your body metabolizes it, it causes <a href="http://www.huffingtonpost.com/2012/02/27/sleep-stages-what-happens-during-sleep_n_1297941.html" target="_hplink">REM sleep</a> to rebound," she warns, which can cause those strange, post-drinking dreams that wake you up. Alcohol also causes what's called sleep fragmentation, meaning you wake up more often during the early-morning hours, or wake up early and can't get back to sleep at all, Baron explains. She recommends teetotaling at least two hours before bed, and considering cutting down on alcohol throughout the day.   • The Day Off

    If you're a night owl, you'll likely be tempted to stay up later than usual for a Tuesday night, given Wednesday's holiday, and possibly again on Wednesday depending on how you plan to celebrate. It could also be tempting to sleep later than usual on Wednesday morning, in an attempt to make up for some of the sleep you may have already missed out on this week. "Pyschologicaly, it's nice to have a break mid-week," says Baron. But in both cases, you could be stuck spending the next couple of days trying to get back on track for your work-week sleep schedule, says Baron, and, before you know it, it's the weekend again, when many people experience what's come to be known as <a href="http://www.huffingtonpost.com/2012/05/11/social-jet-lag-weekend-harm-health_n_1507396.html" target="_hplink">social jet lag</a>. "In the short term, it's a balancing act," says Baron. You may be able to catch up a little bit this week, or you might feel groggy when it comes time to get up for work Thursday morning, she says. Most experts recommend trying as much as possible to go to sleep and wake up at the same time every day -- even on weekends and holidays.

  • The Heat

    The sky-high temps outside aren't unique to the Fourth, but there's no ignoring the recent heat wave. "It is definitely difficult to sleep in a hot environment," says Baron. She recommends sleeping in light clothing, kicking snuggly pets out of the bed and even keeping a small ice pack in the freezer than you can take to bed with you if you really can't get relief. Tie a Tie

Ever find yourself getting ready for a big date, or an important dinner, only to realize you have no idea how to tie your tie? Now you need to grab some ties, run across the house, hop on the computer and hope that YouTube has a good video for you to follow, right? Well, wrong. Grab your Android device, download a free app and boom -- learn how to tie one of many knots while on the go. Whether you want a Kelvin, a Windsor, or maybe just a Simple Double, you can learn with ease all from one free application.

The application itself is quite simple, launch it, check out the pictures to see which kind of knot you prefer, and then click on that one. Once you have opened a knot it will then teach you in a few simple pictures how to properly tie it, and then you are ready to go. If you are unsure of which type of knot to use for which occasion, clicking on the knot will bring a quick summary of when it is ideal to tie that type, and that will help you decide.

As far as options go you won't find many of them here. From the main page you can access a small menu that allows you to view the pictures normal, or as you would view them in a mirror. This can be a huge help since many will probably be attempting this in front of a mirror, and with the pictures showing as such it will make it easier to understand. The application is free, and ad supported, and while you won't use this type of thing regularly throughout your day, it could definitely come in handy. FDA approves new home-use HIV test

WASHINGTON ? The Food and Drug Administration approved the first over-the-counter HIV test Tuesday, allowing people to test themselves in private at home and get preliminary results in less than 30 minutes.

"Knowing your status is an important factor in the effort to prevent the spread of HIV," Dr. Karen Midthun, director of the FDA's Center for Biologics Evaluation and Research, said in a statement. "The availability of a home-use HIV test kit provides another option for individuals to get tested so that they can seek medical care, if appropriate."

The test, manufactured by OraSure, already had been approved for medical clinics. The new at-home test, called OraQuick, will be sold in supermarkets and pharmacies beginning in October.

Tests for the human immunodeficiency virus, which causes AIDS, have become increasingly simpler and quicker to use since their introduction in the 1980s. In 2002, the FDA approved the first on-the-spot tests for clinics. In 2005, the FDA began exploring the possibility of approving a home test.

The FDA emphasized that any results from a self-administered test, which works by detecting antibodies in a swab from the gums, should not be considered final. In trials, the test failed to detect HIV in 1 in every 12 patients known to be infected, and returned false positives in 1 in 5,000 cases. Anyone receiving a positive result should follow up with a medical provider, the agency said.

In May, an FDA advisory panel unanimously recommended that the test be approved, saying the benefits outweighed the risks. One concern has been that people who learn that they are infected may not have immediate access to counseling or support.

The agency said it hoped the new tests would reach people who were not getting tested, which, in turn, could lead to early treatment and reduce the transmission rate of the virus.

Previously, the FDA approved an HIV home test, but the samples had to be sent to a laboratory for analysis.

The federal Centers for Disease Control and Prevention estimates that of the 1.2 million people in the U.S. with HIV, 1 in 5 is not aware of the infection. And it says that a disproportionate number of the 50,000 new cases of HIV each year is linked to people who have not been tested.

OraSure has not said how much the test will cost, only that it will be more than the $18 cost for the professional kit.

Kevin Frost, chief executive of the Acquired Immune Deficiency Syndrome research group amfAR, said although he thought home testing was a good idea, a high price tag could put it beyond the reach of those who needed it most.

"If the people who go out and pay for this test end up being sorority girls who had a one-night stand and worry if they're infected, that's not going to be a net positive," he said.

Doug Michels, president of OraSure, acknowledged that pricing was a "fine balance," but said his company's product was not designed to replace other options.

Chip Lewis, a spokesman for Whitman-Walker Health, which provides AIDS care in Washington, said at-home testing could reach some people who didn't want to go to a clinic. But removing medical professionals from the process could cause problems, he said.

"It's not like a home pregnancy test," he said. "You need really a lot of information about how to read the test, how to use the test properly."

Michels said OraSure's research showed that the vast majority of people receiving a positive result said they would seek medical advice. The FDA also required OraSure to run a call center to support users of the test. Michels said trained counselors would answer the calls.

(AP) ? Now that she's on her way to the Olympics, Gabby Douglas has a new goal.

"I'm hoping I can catch an accent," she said. "I've always wanted an accent."

Look out London. The 16-year-old whose "Flying Squirrel" nickname might be the only thing more appealing than her personality or her high-flying uneven bars routine is ready to take on a new continent after upsetting world champion Jordyn Wieber to win the Olympic trials Sunday night.

Oh, she's bringing friends, too. Led by the 1-2 punch of Douglas and Wieber, this will be the strongest team the Americans have had since 1996, one that will be not just favored but expected to bring home only the second Olympic team gold.

McKayla Maroney and Aly Raisman, who were with Douglas and Wieber on the U.S. team that won the title at last fall's world championships, also made the team, as did Kyla Ross.

"This is a very strong team. I feel this team is even stronger than four years ago," said Douglas' coach, Liang Chow.

Considering that 2008 squad had Nastia Liukin, Shawn Johnson and Alicia Sacramone, that's a pretty bold statement. After seeing Douglas' stunning ascension over the last six months, however, no one should bet against her and the Americans.

"You want to peak at the right time," Douglas said. "And also still be awesome and great."

Douglas convinced her mother to let her leave her hometown of Virginia Beach, Va., almost two years ago to move to Iowa and train with Chow, Johnson's coach. Though she was a member of that world team, few would have ever guessed that she, rather than Russia's Aliya Mustafina or Viktoria Komova, would present the biggest challenge to Wieber.

But she raised eyebrows at the American Cup in March by beating Wieber. Never mind that her scores didn't count because she was competing as an alternate. She came up just short at nationals last month, and again the first night of trials.

On Sunday night, however, Douglas would not be denied again.

She opened with a massive vault, soaring high above the table with her legs pencil-straight and body tightly coiled, and she needed only a small hop to the side to steady herself on her landing. She broke into a big grin as she thrust her hands in the air, and she trotted off the podium with her fists still raised. Her score of 16 ? including a huge 9.5 for execution ? moved her into first place, a spot she never relinquished.

She extended the lead on uneven bars, her signature event. Douglas is so light and quick as she flies between the bars that U.S. women's team coordinator Martha Karolyi has dubbed her the "Flying Squirrel," and she gets such great height on her release moves she could have dusted off the Jumbotron. But it is her grace that makes her stand out, looking like a ballerina in a jewelry box as she pirouetted on the high bar. There's some hard-core steel beneath that pretty package, however. On one transition, Douglas' hand seemed to slip on the bar, something that would have made most gymnasts go flying. But she kept right on going, never even hesitating.

When she landed her dismount, the arena responded with a roar that was probably heard in San Francisco. Her score of 15.9 gave her a 1.35-point lead over Wieber with two events left.

But balance beam has been giving Douglas problems all month ? a fall the second day of the U.S. championships cost her the title ? and Sunday night was no different. She had to windmill her arms to stay upright after a series of back handsprings, and she rocked and swayed for another several seconds after a back somersault. Her score of 14.85 was her lowest of the two-day trials, and cut her lead to 0.6 going into the final rotation ? leaving plenty of room for Wieber, who finished on vault, the highest-scoring event.

Wieber didn't get her normal height on vault, however, and landed low, needing to take a step back to steady herself. A minor error, for sure, but it meant Douglas needed to score only a 15.25 or better on floor exercise to win.

With a show worthy of Vegas, Douglas had the crowd rocking and rolling to her techno music. Basketball players would be envious of the hops she got on her tumbling runs, yet she landed them with such security there's got to be some glue somewhere on those feet. She pranced across the floor as if she owned the place, and never once stopped smiling.

"Winning or not winning at this meet is really secondary," Chow said. "Clearly we saw here that her mental strength and gymnastics strength is coming along."

When she finished, Chow greeted her with a bear hug. And that was before they saw her score: a 15.3 that gave her a total of 123.45, just enough to hold off Wieber.

"Everyone was telling me you have this great potential and you can be on top," Douglas said. "I didn't believe that, but everyone was just telling me to believe in myself. I did and I'm kind of up on top and it's amazing."

While Douglas is clearly a star on the rise, Liukin is exiting the stage ? this time for good.

Hampered by shoulder problems and a clock that wouldn't stop ticking, Liukin never returned to the form that made her the 2008 Olympic champion. She fell on uneven bars, her signature event, when her fingertips could only brush the bar after a release move, and needed to take a step back after landing her dismount on the edge of the mat.

But she refused to quit, and the crowd gave her a standing ovation. She finished off her career with a respectable routine on balance beam. As she walked off the podium, her father and coach, Valeri, greeted her with a kiss and fans began to stand once again.

Tears filled Liukin's eyes as she waved and said goodbye, to the crowd, her comeback and a career that includes five Olympic medals and four world titles.

"Of course I wanted to go out and put two good performances out there and end my career that way, so it's a little upsetting," Liukin said. "Today is something that I'll remember for the rest of my life. It can easily compare to winning the all-around gold medal to me. Those are pretty much the two highlights of my career ... winning an all-around gold medal and getting a standing ovation not once but twice."
